By using ClearChat ("the service," at clearchat.net), you agree to these Terms. If you do not agree, please do not use the service.
1. What ClearChat is
ClearChat is a free tool that lets two people connect their web browsers directly for voice, video and text. It is offered for personal, lawful use. There are no accounts and no fees.
2. Provided "as is" — no warranties
The service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to fitness for a particular purpose, reliability, availability, accuracy, security, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, secure, or that connections will succeed.
3. No liability
To the maximum extent permitted by law, ClearChat, its operator and contributors accept no responsibility or liability whatsoever for any loss or damage of any kind arising from or related to your use of (or inability to use) the service. This includes, without limitation:
- the content, conduct, or consequences of any call or message between users;
- failed, dropped, delayed or poor-quality connections, or unavailability of the service;
- loss of data, including saved contacts or call history stored in your browser;
- exposure of your IP address or other technical information inherent to peer-to-peer connections;
- any interception, impersonation, or security incident, including during first-time connections;
- the acts, omissions or content of any other user; and
- any third-party services the site relies on (such as hosting, fonts or analytics providers).
You use the service entirely at your own risk.
4. Your responsibilities
You are solely responsible for how you use ClearChat and for everything you communicate through it. You agree not to use the service to:
- break any applicable law or regulation;
- harass, threaten, defame, or harm others, or share illegal, abusive or infringing content;
- record or share another person without their consent where consent is required;
- attempt to disrupt, overload, reverse-engineer, or gain unauthorised access to the service or its infrastructure.
5. We cannot and do not monitor your calls
Calls are peer-to-peer and end-to-end encrypted. We have no ability to see, hear, record, moderate or retrieve the content of any communication. Accordingly, responsibility for all communications rests entirely with the users involved.
6. Peer-to-peer connection
Because connections are direct, participants exchange IP addresses and related technical data. By using the service you acknowledge and accept this.
7. Availability
The service may be changed, limited, suspended or discontinued at any time, without notice and without liability.
8. Indemnity
You agree to indemnify and hold harmless the operator of ClearChat from any claims, damages, losses or expenses arising out of your use of the service or your breach of these Terms.
9. Changes to these Terms
We may update these Terms at any time. Changes are effective when posted, indicated by the "last updated" date. Continued use means you accept the updated Terms.
10. Governing law
These Terms are governed by the laws of the operator's place of residence, without regard to conflict-of-law rules, except where mandatory consumer-protection laws of your own country apply.
